Terms of Service

These Terms of Service ("Terms") are an agreement between you and Mont Pelerin Workspace LLC ("Mont Pelerin", "we", "us") and govern your use of the website montpelerin.com and the Mont Pelerin online coworking service (together, the "Service"). Please read them before creating an account. By creating an account or using the Service you agree to these Terms and to our Privacy Policy.

1. The Service

Mont Pelerin is an online coworking place. Members can join live rooms, send messages, make audio and video calls, and keep a record of work sessions. Teams can create a private floor for their members. We may add, change, or remove features over time; if a change materially reduces what a paid plan includes, we will tell you in advance and you may cancel.

1a. Early access

The Service is currently offered in early access. Joining the early access list through our website does not create an account or a paid subscription; it is a request to be invited. We may limit how many members we onboard and when. You will not be charged anything until you accept an invitation and choose a paid plan. During early access some features may change or be temporarily unavailable; we will tell you about material changes by email.

2. Eligibility and accounts

  • You must be at least 18 years old to use the Service.
  • You must give accurate information when you register and keep it up to date.
  • You are responsible for keeping your password confidential and for activity under your account.
  • One person per account. Team administrators are responsible for the members they invite.

3. Plans, billing, and cancellation

  • Open Desk is free.
  • Pro Desk and Team Suite are paid monthly subscriptions. Prices are shown on the pricing page in US dollars, exclusive of applicable sales tax.
  • Paid plans are billed in advance and renew automatically every month until cancelled.
  • Team Suite is billed per active member. Members added during a month are prorated; members removed stop being billed at the next renewal.
  • You can cancel at any time in your account settings or by emailing hello@montpelerin.com. Cancellation takes effect at the end of the current billing period. There are no cancellation fees.
  • If we change prices, we will give at least 30 days' notice by email before the new price applies to you.

4. Refunds

If you are not satisfied within the first 14 days of your first paid month, email us and we will refund that month in full. After that, payments are non-refundable except where required by law or where the Service was unavailable for a substantial part of a billing period due to our fault, in which case we will credit or refund the affected period on request.

5. Acceptable use

You agree not to:

  • Harass, threaten, or abuse other members, or share content that is unlawful, hateful, or sexually explicit;
  • Record calls or rooms without the clear consent of everyone present;
  • Send unsolicited commercial messages to other members;
  • Attempt to access accounts or systems you are not authorised to access, or interfere with the Service;
  • Use the Service to infringe anyone's intellectual property or privacy rights;
  • Resell the Service without our written permission.

We may suspend or terminate accounts that break these rules. Where reasonable, we will warn you first.

6. Your content

You keep ownership of messages, notes, and other content you create in the Service. You give us a limited licence to store, transmit, and display that content as needed to run the Service for you and the members you share it with. We do not use your content to train models or for advertising.

7. Our intellectual property

The Service, the Mont Pelerin name and logo, and our software and design are owned by us or our licensors. These Terms do not grant you any right to use them other than to access the Service.

8. Availability and support

We aim to keep the Service available at all times but do not guarantee uninterrupted access. Planned maintenance will be announced in advance where possible. Support is available by email at hello@montpelerin.com during business hours.

9. Disclaimer of warranties

The Service is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose, or US $100 if you paid nothing. Some jurisdictions do not allow these limits, in which case they apply to the extent permitted.

11. Termination

You can close your account at any time. We may suspend or close your account for breach of these Terms, for non-payment, or if we discontinue the Service (with at least 30 days' notice and a pro-rata refund of prepaid fees in that case). Sections 6, 7, 9, 10, 12, and 13 survive termination.

12. Governing law and disputes

These Terms are governed by the laws of the State of South Carolina, USA, without regard to conflict-of-law rules. Before filing a claim, you agree to contact us and try to resolve the dispute informally for 30 days. Courts located in South Carolina have exclusive jurisdiction, except that either party may seek injunctive relief in any competent court. Nothing in this section removes consumer protections you are entitled to under the law of your home jurisdiction.

13. Changes to these Terms

We may update these Terms. We will post the new version here and update the date above; for material changes we will email account holders at least 14 days before they take effect. Continued use after that date means you accept the new Terms.
